The petitioners suffered a decree of eviction in title Suit No.157 of 2001 and aggrieved by the said decree, have preferred the connected Title Appeal No. 165 of 2010 which pending before the Fast Track Court Chandernagore.

The petitioners by the present application under Article 227 of the Constitution of India are praying for direction upon the Appeal Court below for expeditious disposal of the said appeal. It appears from the certified copy of the order passed in the said appeal that the matter has been fixed for final argument.

That being the position of the said appeal the Appeal Court below is requested to dispose of the said appeal as expeditiously as possible

preferably within a period of four weeks from the date of communication of this order without granting any unnecessary adjournment to either of the parties.

C.O. 289 of 2021 is, thus, disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Biswajit Basu, J.)
