15.02.2023 sdas rejected C.R.M. (NDPS) No. 263 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No. 271 of 2022 dated 03.03.2022 under Sections 21(c )/29 of the NDPS Act.

And In Re : Haripada Kirtaniya ..... petitioner Mr. Asraf Mandal ... for the petitioner Mr. Sanjoy Bardhan Ms. Debjani Dasgupta ... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Statements of the witnesses and contemporaneous documents show recovery of 710 grams of Heroin from the possession of the petitioner. Under such circumstances and statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
