The petitioners challenged the proceedings relating to the chargesheet filed in connection with Burdwan Sadar Police Station Case No. 833 of 2016 dated09-08-2016.

Mr. Mukherjee, learned advocate appears on behalf of the State. Learned advocate submits that he has no instruction that there has been any further development in between the parties. I have perused the contentions advanced in this revisional application but I find that the case was initiated in the year 2016 and chargesheet was submitted before the jurisdictional court within a reasonable period of time.

Having regard to the fact that the enclosures to the revisional application do not contain the documents under Section 207 of the Code of Criminal Procedure, I am of the view that the mode and manner in which the revisional application has been preferred is premature.

Petitioners would be at liberty to take the issues before the jurisdictional court by taking out an application under Sections 227/239 of the Code of Criminal Procedure. Learned jurisdictional court will decide the matter in accordance with law without being influenced by any observations made by this court while disposing of the present revisional application.

With the aforesaid observations, the revisional application being CRR 506 of 2023 is disposed of.

The connected application being CRAN 1 of 2023 is accordingly dismissed.
