Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He refers to the statements of the injured recorded before the learned Magistrate. He submits that at the time when a social function was going on, the petitioner and the other accused barged in and severely assaulted the victims with sharp cutting weapons like sword. Several injuries were inflicted on vital portions of the body like scalp, face and other portions like finger. A thumb had to be amputated.
Considering the serious nature of allegations, the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail to the present petitioner. The application for anticipatory bail of the petitioner is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
