Mr. Mukteswar Maity Mrs. Manika Sarkar ...for the petitioner Mr. Chandi Charan De Mrs. Chandrima Ghosh ...for the State In terms of an order passed by a Coordinate Bench of this Court on 20.11.2019 in W.P.No. 10969(W) of 2019 the Assistant Engineer, Bongaon Highway Sub-Division, P.W. (Roads) Directorate took up the representation submitted by the petitioner for consideration pursuant to which a proposal for direct purchase of the plot in question was recommended and sent to the Executive Engineer, Barasat Highway Division No.II, P.W.(Roads) Directorate on 05.11.2020 for further necessary action. The Executive Engineer, in turn, recommended and forwarded the proposal to the Superintending Engineer, Eastern Highway Circle, P.W.(Roads) Directorate on 10.11.2020 which was thereafter sent to the Superintending Engineer, State Highway Planning Circle, P.W.(Roads) Directorate on 27.11.2020 for initiating necessary action.
The petitioner complains that the matter is still pending. The petitioner prays for a direction upon the
authority to dispose of the matter as expeditiously as possible.
Learned counsel appearing on behalf of the Staterespondents submits that the 3rd respondent be directed to consider the matter at the earliest.
In view of the fact that the proposal for direct purchase is pending recommendation and further action for quite sometime, the writ petition is disposed of directing the 3rd respondent to consider the said proposal and initiate necessary action in this regard within three months from the date of communication of this order, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. Accordingly, this writ petition is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
