The revisional application has been preferred challenging the order 03.09.2011 passed by the learned Judicial Magistrate, 1st Court, Suri, Birbhum in Misc. Case No. 53 of 2010.

The order dated 03.09.2011 reflects that the learned Magistrate was pleased to refuse the order of interim maintenance on the plea of the husband, being the present petitioner, regarding the factum or the plea which was taken up that the applicant was not a legally married wife. By the same order, the learned Magistrate was pleased to fix a date i.e, 14th November, 2011 for evidence.

Having regard to the nature of order which has been passed by the learned Magistrate, I am of the view that there

has been no illegality committed by the learned Magistrate which requires interference by this court.

Thus, the present revisional application being CRR 380 of 2012 is dismissed.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
