Mr. Banik, learned advocate appearing for the petitioner/plaintiff/landlord submits that two petitions one under Section 7(1) and another under Section 7(2) of the W.B.P.T. Act was filed on 30th January, 2021, but on the date of filing itself, petition under Section 7(1) of the W.B.P.T. Act has been disposed of keeping the petition under Section 7(2) of the W.B.P.T. Act deferred.
The only contention expressed by the learned advocate for the petitioner is against the delay caused in the disposal of petition under Section 7(2) of the W.B.P.T. Act.
Admittedly, the suit is instituted in the year 2020.
In view of the nature of order proposed to be made, no prior notice is considered to be necessary. Service upon the opposite party stands dispensed with. Accordingly, learned Civil Judge (Senior Division), 3rd Court, at Howrah, is requested to ensure expeditious disposal of interlocutory petition under Section 7(2) of the W.B.P.T. Act, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable. Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite party and opposite party as well.
With this observation/directions, the revisional application stands disposed of.
