The subject matter of the case relates to a charge-sheet being filed by the investigating officer in connection with Lake Town Police Station Case No. 14 dated 5.2.2010.
The petitioner approached this Court at a stage when the learned Magistrate was in seisin of the case and was at the stage of consideration of charge.
Records of this revisional application reflect that the interim order was granted on 12.4.2012 for a period of one week after the summer vacation of the said year.
Mr. Binay Panda, learned advocate, appears on behalf of the State and submits that there are sufficient materials for the proceedings to continue and no case has been made out for interference at this stage.
Having regard to the issues which have been raised in the application under Section 239 of the Code of Criminal Procedure, I am of the view that the same relate to question of facts and cannot be adjudicated by this Court as the same is of prematured nature.
Accordingly, CRR 387 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
