Petitioner complains that between the petitioner and the private respondents several cases are pending and there are disputes which are being adjudicated. However, the police authorities in spite of being informed relating to the illegal construction, no action has been taken.

Mr. Banerjee, learned advocate, along with a junior of his choice represents the State. Their appointment may be regularized by the concerned authorities.

A report has been handed over by the learned advocate appearing for the State which reflects that a partition suit has been filed before the learned Civil Judge (Senior Division), Lalbagh,

Murshidabad. Steps have been taken by the police authorities under Sections 126/135(3) of the BNSS. Having considered that the police authorities are in knowhow of the differences and dispute between the petitioner and the private respondents. In case the civil court passes any direction, the police authorities would respect, obey and implement the order of the civil court. In the meantime, police authorities would keep a strict vigil and ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the strained relationship between the parties.

With the aforesaid observations, WPA 3667 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
