Petitioner is aggrieved by the fact that a bank guarantee was furnished by the respondent no. 6. Grievance of the petitioner which happens to be a public sector undertaking is that in spite of registration of the FIR being Manicktala PS Case No. 288 dated 02.12.2022 there has been no progress in the investigation of the case.

I have considered the report. The report is not encouraging as I find that the nature of document based investigation to be carried out is palpably lacking on the face of the report.

Learned advocate for the respondent no. 7 (Bank Authorities) is present.

Having considered the nature of investigation, I am of the view that there is lack of infrastructure with the local police station. Accordingly, the investigation of the Manicktala Police Station Case No. 288 dated 02.12.2022 is transferred to the Anti-Cheating Section, Detective Department, Lalbazar, Kolkata. The Assistant Commissioner in-charge of the AntiCheating Section will depute an officer of his choice for effectively carry forward the investigation of this case.

The concerned Investigating Officer of Manicktala Police Station is directed to immediately handover the case diary and other records to the Assistant Commissioner of Police in-charge of AntiCheating Section, Detective Department, Lalbazar, Kolkata.

With the aforesaid observations WPA 3470 of 2025 is disposed of.

Report so submitted be kept with the record.

Copies of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
