Mr. Raj Kr. Sain ....for the petitioner Mr. Ashutosh Pathak ....for the UOI Affidavit of service filed in Court today is taken on record.
The petitioner claims to be the owner of a portion of land being L.R. Plot No.553 in L.R. Khatian No.1150 within Mouza-Kamarda under Police Station-Nandakumar in the District of Purba Medinipur.
The petitioner claims to have submitted a representation dated January 15, 2026 before the Project Director, National Highway Authority of India, praying for grant of temporary lease or license for commercial purpose in respect of a land which is situated in front of the portion of the Rayati land of the petitioner, which belongs to the National Highway Authority of India for commercial purpose.
The learned advocate appearing for the petitioner submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioner till date.
Union of India is represented by its learned advocate.
Without entering into the merits of the claim made by the petitioner in the representation dated January 15, 2026, WPA 3574 of 2026 stands disposed of by directing the Project Director, National Highway Authority of India, Project Implementation Unit, Kolkata Office, being the respondent No.2 to consider the representation of the petitioner dated January 15, 2026 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing for the petitioner or his authorised representatives and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated January 15, 2026.
There will be no order as to costs.
