A direction to secure expeditious disposal of Money Suit is the ultimate relief, prayed for in this revisional application.

In view of the nature of the order proposed to be made in this case, service of notice of this revisional application upon the opposite parties is considered to be not necessary.

Admittedly in the year 2016, Money Suit came to be instituted.

Upon perusal of the some photocopy of orders, it appears that interlocutory application dated 22nd April, 2019 is awaiting decision to be rendered by the learned Court below.

It is disclosed by the learned advocate for the petitioner that till date issues have not been framed as yet.

Having considered the submissions made by the learned advocate for the petitioner, and bearing in

mind the materials disclosed in the photocopy of orders passed by the learned Court below, annexed with the instant revisional application, learned Civil Judge, 9th Court (Senior Division) at Alipore in Money Suit No. 192 of 2016 is directed to ensure expeditious disposal of pending interlocutory application, preferably within a period of six months from the date of communication of this order without granting unnecessary adjournments, unless it is extremely unavoidable.

After disposal of the interlocutory application, this Court reposes trust and confidence upon the Ld. Court below that issues may be framed thereafter in the pending suit, so that the case may be expeditiously disposed of, and in endeavouring such exercise, an opportunity of hearing to both the parties must be ensured.

With this direction and observation, revisonal application stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
