The petitioner approached this Court at the stage when the investigation of the case was in progress. The foundation of interference with the FIR was on issue of payment which has already been made. During the pendency of this revisional application, the investigating agency has already completed the investigation and submitted a report under Section 173 of the Code of Criminal Procedure. The case has already been transferred to the learned Judicial Magistrate, 3rd Court, Purba Bardhaman.

Mr. Imran Ali, learned advocate appearing for the State, submits a report of the Inspector-in-Charge, Ausgram Police Station. Let the said report dated 11.08.2021 be kept with the record.

The report of the Inspector-in-Charge, Ausgram Police Station reflects that charge has already been framed on 23.06.2014 under Sections 406/420/120B of the Indian Penal Code. Date has been fixed for examination of witnesses. Having regard to the stage of the case that the evidence has already commenced, I am of the view that no interference is called for at this stage. Accordingly, CRR 393 of 2012 is dismissed.

Interim order, if any, is hereby vacated.

All pending applications, if any, are consequently disposed of.
