Mr. S.R. Kundu .......for the petitioner Mr. Bhaskar Prosad Vaisya, ld. A.G.P., Mr. Ranjan Saha ....for the State The father of the petitioner died-in-harness as an Assistant Teacher on 05.01.1986.

Thereafter, the petitioner as the sole legal heir of the deceased employee and had applied for pension and provident fund and other terminal benefits on account of the death of his father. There is no progress in the matter till date. In that view of the matter, this court directs the School authorities as well as the D.I. of Schools (SE), Purulia, and the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, to take a decision on the petitioner's claim for pension and if found entitled, the same may be furnished to him in accordance with law, within a period of two months from date.

The question of interest on the delayed payment has not been considered by this Court. The concerned school and the petitioner shall furnish all the necessary papers, as will be required, to the D.I. of Schools, for the aforesaid purpose.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
