State has submitted a report. Report reflects that no warrant of arrest is pending in Chakdah Police Station so far as the case in respect of which warrant has been issued by the learned Judicial Magistrate, 2nd Court, Barrackpore.

Learned advocate appearing for the petitioner submits that in respect of the execution case some money has been deposited before the learned Judicial Magistrate, 2nd Court, Barrackpore.

In view of the circumstances presently prevailing, I direct the learned Judicial Magistrate, 2nd Court, Barrackpore to issue warrant of arrest in connection with Mex 33/20 through the superior officer being SDPO/Additional SP-in-Charge of Chakdah Police Station. The concerned superior officer through his authorised officer would submit

the report before the jurisdictional Magistrate and who would put in efforts to trace out the said Rajkumar Mondal. Till date the execution of warrant of arrest is pending, as such, the superior officer would compel his subordinates and/or use his good office for tracing out the said Rajkumar Mondal in order to comply the solemn order of the learned Judicial Magistrate, 2nd Court, Barrackpore.

With the aforesaid observations, WPA 3506 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
