Versus

The State of West Bengal and others Mr. Sakti Pada Jana ... for the petitioner.

After hearing learned counsel appearing for the parties, this court is of the view that the grievance of the writ petitioner in respect of the State Transport Authority not indicating the alignment granted with the permit may be resolved by directing the State Transport Authority to consider the representation made by the petitioner and received by the former on 18th November, 2021 and dispose of the same by way of passing a reasoned order. The State Transport Authority shall be at liberty of hearing all concerned parties including the petitioner before passing the reasoned order and considering the relevant statutory provisions and regulations for the same. The reasoned order shall be made available to the petitioner within four weeks from date and a copy of the same be made available to the petitioner within two weeks thereafter.

Since the representation of the petitioner has not been considered by the concerned Authority from

November, 2021 onwards, the petitioner shall be at liberty to ply his vehicle in the existing timetable till the reasoned order is passed.

W.P.A.3290 of 2022 is disposed of in terms of the above.
