We have heard learned counsel for the parties.

This contempt application has been filed alleging willful disobedience of the order and direction dated 19.09.2023 passed in WPA(P) 495 of 2023.

In the contempt application in paragraph 6 it has been stated that the regulatory market has not started functioning till date and as such due to delay and negligent attitude of the respondent/alleged contemnor, the farmers of the District has been suffering a huge loss directly affecting their livelihood. The order and direction was issued to the Additional Chief Secretary, Agricultural Marketing Department, Government of West Bengal to consider the representation and examine the prayer made for commencement of the functioning of the Kalimpong Regulatory Market.

We find that there is no specific direction to

open the regulatory market.

In any event, the representation has to be considered. Therefore, we direct the Additional Chief Secretary, Agricultural Marketing Department, Government of West Bengal to comply with the directions issued in the writ petition dated 19.09.2023 positively within three weeks from the date of receipt of the server copy of this order and communicate the order to the writ petitioner by speed post with acknowledgment due. 5.

Thus, with the above observations, the contempt application stands disposed of.
