Learned Counsel for respondent-Uluberia Municipality appears and states that the officials of the respondent-municipality had visited the site of the petitioner's property. They are in a position to grant water connection but due to strong resistance from the neighbor they were unable to grant water connection to the petitioner.

Learned Counsel for the respondentmunicipality states that if adequate police protection is granted to them, they will be in a position to effect water connection to the petitioner's premises. 4.

It is the fundamental right of every citizen to obtain a water connection, and it is the duty of the state respondents to ensure that this fundamental right, guaranteed under Article 21 of the Constitution

of India, is not infringed in any manner. The petitioner is seeking a water connection for domestic purposes, and the same cannot be denied to him on the basis of objections raised by the neighbors.

In view thereof, this Court directs the Officer-inCharge, Uluberia P.S. to provide adequate police protection to the respondent in providing the water connection to the premises of the petitioner. 6.

With the above direction, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
