The petitioner has applied for transfer on medical grounds from Sundargeria Primary School under Garhbeta West Circle to any school in Debra Circle. 3.

In those circumstances, the Chairman, DPSC, Paschim Medinipur shall refer the petitioner's case to the CMOH, Paschim Medinipur and ascertain the medical condition of the petitioner as to whether he would have difficulty in travelling a distance of 102 kms. from his residence on a daily basis.

Based on the opinion of the CHOH, Paschim Medinipur, let a suitable decision be taken by the Chairman, DPSC, Paschim Medinipur for posting of the petitioner in any school in Debra Circle subject to availability of the vacancy in accordance with law within a period of two months from date.

The writ petition is disposed of.

There will be no order as to costs.
