The Prodhan has considered the prayer of the petitioners and has come to a definite finding that the construction made by the persons responsible is an unauthorized one.

The Prodhan directed the persons responsible to demolish the unauthorized construction.

Being aggrieved by the said order of demolision the persons responsible approached this Court by filing writ petition being WPA 24193 of 2022 ( Amal Shit & Anr. v. The State of West Bengal & Ors.). The said writ petition was disposed of by the Court on November 21, 2022 by setting aside the order passed by the Prodhan for demolition. The Court directed that the matter be referred to the Sub-Divisional Officer in terms of Section 23(5) of the West Bengal Panchayat Act, 1973 within a stipulated time period.

As it appears that the Prodhan has already taken into consideration the objection filed by the petitioners and passed necessary order, accordingly the order passed by this Court stands complied. There is no

requirement of continuing with the contempt application any further.

The contempt application stands disposed of.
