The petitioners have filed the present writ application on the ground that the petitioner no. 2 (since deceased) had made a representation to the Secretary, Law Department, the Inspector General of Registration as well as to the District Registrar, Murshidabad requesting for initiate appropriate enquiry regarding the conduct of Muhammadan Marriage Registrar (MMR) in terms of Rule 10 of the Bengal Muhammadan Marriages and Divorces Registration Rules, 1929 and for taking appropriate steps against the private respondent.

2. During the pendency of the present writ application the petitioner no. 2 passed away. Accordingly, his name has been deleted from the cause title of the present case.

3. Learned counsel appearing for the State submits that on receipt of the compliant from the petitioner, the

respondent no. 3 had called the private respondent and the petitioners. The petitioners did not appear and file the present writ application. He submits that if the petitioner makes comprehensive representation to the respondent no. 3, the respondent no. 3 will consider the grievance of the petitioner by giving opportunity of hearing to the petitioner as well as the private respondent.

Considering the above, this writ petition is disposed of by directing the petitioner to make a comprehensive representation to the respondent no. 3 within a period of a week from date and if any representation is made by the petitioner, the respondent no. 3 shall consider the representation and pass reasoned and speaking order by giving opportunity of hearing to the petitioner as well as the private respondent.

5. WPA 3385 of 2023 is disposed of.

6. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
