On the prayer of the learned Advocate for the petitioner leave is granted to add the Executive Engineer, Damodar Head Works Division, Irrigation and Waterways Directorate, Government of West Bengal as a partyrespondent in this writ proceeding. Mr.

Chandi Charan De, learned Additional Government Pleader appearing on behalf of the Staterespondent informs this Court that the Executive Engineer, Damodar Head Works Division, Irrigation and Waterways Directorate, Government of West Bengal, added respondent no.5 is ready and willing to purchase the subject-land of the petitioner as per Government Purchase Rules, 2016.

Mr. D.N. Bose, learned Advocate for the petitioner accepts the proposal advanced on behalf of the Staterespondent. Accordingly, the present writ petition being WPA 3387 of 2023 is disposed of by directing the Executive Engineer, Damodar Head Works Division, Irrigation and Waterways Directorate, Government of West Bengal, added respondent no.5 to take appropriate steps for execution of the deed of purchase in respect of the subject-land upon ascertainment of the extent of right of the petitioner over subject-land within a period of four months from the date of conclusion of General Elections, 2024 in accordance with prevailing Government Purchase Rules, 2016.

It is made clear that this Court has not gone into the merits of this case.

All connected applications, if any, stand disposed of.

There will be, however, no order as to costs. Interim order, if any, stands vacated.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of necessary legal formalities.
