19.02.2025 Sl. No.12 akd [ALLOWED] C. R. M. (A) 552 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed on 12.02.2025 in connection with Suri Police Station Case No.14 of 2025 dated 07.01.2025 under Sections 108/3(5) of the Bharatiya Nyaya Sanhita, 2023. (G.R. Case No.45 of 2025) And In Re: Dalia Das @ Bristi Das & Ors.

... ... Petitioners Mr. Sujoy Sarkar Ms. Sneha Srivastava Ms. Debolina Goswami ... ... for the petitioners Ms. Sayanti Santra Mr. Ronit Mukherjee ... ... for the State 1.

Heard learned Advocates for both the parties. 2.

We have considered the materials on record. There was a romantic relationship between petitioner no.1 and the victim. Petitioner nos.2 and 3 are her relations. Subsequently, petitioner no.1 withdrew from the relationship. Victim committed suicide. It is contended petitioners have been falsely implicated in the instant case. Witnesses state petitioners had ill-treated and abused the victim. Victim did not leave behind any suicide note implicating the petitioners. Whether illtreatment/abuse per se would constitute abetment to suicide would be assessed at the appropriate stage of the proceeding. Under such circumstances, we are of the opinion custodial interrogation of the petitioners is not necessary and they may be granted anticipatory bail. 3.

Accordingly, we direct in the event of arrest, the petitioners, namely, (1) Dalia Das @ Bristi Das, (2) Sukumar Das @ Kanchan Das @ Bhambal & (3) Pinki Das, be released on bail upon furnishing a

bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioners shall appear before the jurisdictional court and pray for regular bail within four weeks from date. 4.

The application for anticipatory bail is, thus, disposed of. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
