Ms. Tuli Sinha ....for the State The petitioner claims to be the owner of R.S. Dag No.257 corresponding to L.R. Dag No.312 within MouzaSaparaypur within the limits of Maheshtala Municipality under Police Station-Maheshtala in the District of South 24-Parganas.
The petitioner states that he came to learn that the though an acquisition proceeding was initiated involving the plot of the petitioner but the acquisition proceeding was not carried further which resulted in lapsing of the acquisition proceeding. The petitioner states that since the property of the petitioner has not been utilised for any public purpose, the same may be released.
The petitioner submitted a representation before the Special Land Acquisition Officer, South 24-Parganas, by a letter dated January 27, 2025, praying for release of the land of the petitioner.
Mr. Bhattacharya, learned advocate appearing for the petitioner submits that in spite of receipt of such
representation, no decision on such representation has been communicated to the petitioner till date. Mr. Dhar, learned senior advocate appearing for the State submits that the decision on such representation shall be communicated to the petitioner within the time limit as may be fixed by this Court.
Without entering into the merits of the claim made by the petitioner in the representation dated January 27, 2025, WPA 3552 of 2025 stands disposed of by directing the Special Land Acquisition Officer, South 24-Parganas, being the respondent No.3 to consider the representation of the petitioner dated January 27, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of 6 weeks from the date of receipt of a server copy of this order together with a copy of the representation dated January 27, 2025.
Since no affidavits have been called for, the allegations contained in the writ petition shall be deemed to have been admitted.
There will be no order as to costs.
