Ld. Advocate for the appellant moves an application for substitution of the sole deceased appellant being registered as CAN 7/25.

From the report as well as the instant petition and supporting documents, it appears that the petition for substitution the deceased sole appellant is filed with the statutory period of limitation and the other formalities has duly been complied.

Accordingly, there is no legal impediment to allow the instant petition.

CAN 07/25 is allowed and the same is disposed of.

Let, the legal heirs of the sole appellant Sufier Rahaman, who died intestate on 30.12.24, as mentioned in para-2 of the instant application for substitution, be substituted in place of the said sole appellant, named above.

The Ld. Advocate for the appellant is hereby directed to submit an amended memo of appeal, incorporating the name of the substituted legal heirs of the deceased sole appellant, within two weeks from this date.
