Petitioner filed this revisional application under Section 401/482 of the Code of Criminal Procedure assailing order dated 15.11.2019 passed by Learned Sessions Judge, Purba Medinipur, granting the prayer for anticipatory bail of the petitioners directing them to furnish bail bond of Rs.50,000/- each with two sureties of Rs.25,000/- each one of which must be local but not in terms of money or cash certificate, subject to the satisfaction of the Arresting Officer and on condition that they shall appear before the Learned A.C.J.M., Contai, twice in a week and report their attendance before the Sessions clerk of the court. In the application it has been contended that if the condition for anticipatory bail is not modified the petitioner will not be able to furnish the bail bond.
In my considered view, since the matter relates to modification of the anticipatory bail conditions, a party cannot have waited for two and half years without any interim order.
The petitioners did not appear before the Court expressing any urgency since passing of the order on 11.02.2020. It appears to me that
the object of this application has become infructuous by now. Since none appears on call, the revisional application is dismissed for default. Let a copy of this order be communicated to the Learned Sessions Judge, Purba Medinipur for information.
