The earlier order dated 16.07.2025 was passed when in the list the reference was with regard to WPA No. 3435 of 2024 (ABS Academy Vs. Baba Saheb Ambedkar Education University and ors. - Item No.775 of monthly list dated 7th July, 2025); as such, none represented the petitioner. Consequently the order which has been decided was on a separate set of facts and not in connection with the present writ petition being WPA 3495 of 2024.

Accordingly, the earlier order dated 16.07.2025 passed in WPA 3495 of 2024 is hereby recalled.

Today when the matter has been called, learned advocate for the petitioner is present. It has been submitted that in connection with Kashipur Police Station Case No. 603 of 2023 dated 27.12.2023, charge-sheet has been submitted before the jurisdictional court.

As none appears on behalf of the State, Ms. Rupsha Chakraborty, learned advocate, who

ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

The grievance of the petitioner when he approached the Court was for effective and proper investigation. The same having been concluded in a charge-sheet, the grievance of the petitioner be addressed before the jurisdictional court. So far as the apprehension of the petitioner regarding threats and coercion is concerned, the petitioner would take out appropriate application before the jurisdictional court. The jurisdictional court will assess whether there is any threat perception of the witnesses concerned and accordingly pass necessary directions under the Witness Protection Scheme, 2018.

With the aforesaid observations, the writ petition being WPA 3495 of 2024 is disposed of. Affidavit-of-service filed in Court today be kept with the record.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
