Petitioner Mr. Tapodip Gupta Mr. Golam Ahammed ...for the petitioner Mr. Sanjay Bardhan Mr. Samarjit Balial ...for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statement of the co-accused, which is not admissible in evidence. Learned counsel appearing on behalf of the State relies on the report and the case diary and opposes the prayer for anticipatory bail. He submits that, other than the materials available in the case diary, there are phone call records between the petitioner and the coaccused. A proclamation has already been issued against the present petitioner.

Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
