Being aggrieved by the judgment and order dated 16th September, 2003 passed by the learned Additional Chief Judicial Magistrate, South 24 Parganas at Alipore in T.R. Case No. 219 of 1999 thereby acquitting the opposite party no. 1 from the charges framed under Section 630 of the Companies Act, 1956.

By an order dated 4th February, 2004, the then Coordinate bench of this Court had granted special leave to prefer the instant appeal against the aforesaid judgment in CRM 19 of 2004.

Learned advocate for the appellant submits written instructions on behalf of the appellant company that the appellant wants to withdraw the instant appeal. Let the said instructions dated 30th September, 2023 be kept on record.

Under such circumstances, the instant appeal is dismissed for non-prosecution.

Interim orders, if any, shall stand vacated.

The report filed by the learned advocate for the State be kept on record.
