Having regard to the averments made in paragraph no. 5 of this application, I am of the view that the petitioner has sufficiently explained the reason for his non-appearance on May 1, 2024.

Accordingly, CAN 1/2024 is allowed and this writ petition is restored to its original file and number. In Re.: WPA 3509 of 2024 The petitioner is not present at the time of call. The petitioner alleges unauthorised construction at the behest of respondent nos. 9, 10 & 11.

Learned advocate appearing for the Corporation submits that the Corporation has already initiated steps under Section 400 of the Kolkata Municipal Corporation Act, 1980.

In that view of the matter, no further order needs be passed in this writ petition. The Corporation shall take steps in accordance with law as expeditiously as possible. Accordingly, WPA 3509 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
