In the matter of:- Tridip Narayan Banerjee Mr. Chirontan Sarkar Mr. Avijit Ghosal ......for the petitioner Mr. Anwar Hossain Mr. Mirza Firoz Ahmed Begg .....for the State This is an application seeking expeditious disposal of a proceeding in which charge sheet was submitted under Sections 498A, 406, 506 and 34 of the Penal Code. Let a copy of this application be served upon Mr. Anwar Hossain and Mr. Mirza Firoz Ahmed Begg, learned counsels, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. Although, the FIR was lodged on 01.02.2017, till date the proceeding could not be concluded. Long dates are being fixed. The next date fixed for hearing is on 21.05.2022. The proceeding has remained pending for no fault of the present petitioner. Learned counsel on behalf of the State that no inordinate delay has been occasioned in this case. Due

to the huge workload of cases pending before the learned trial Courts, there are persons who are suffering custody trial in respect of the charges under the NDPS Act since 2018. Therefore, this not a fit case for expediting the proceeding.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It does not appear that an inordinate delay has been occasioned in this case.

However, it is expected that the learned trial court would conclude the proceeding at the earliest. With these observations, the revisional application is disposed of.
