Mr. Sarwar Jahan Mr. Ashraf Mondal Mr. Asif Mehdi ..for the petitioner Mr. Mrityunjoy Goswami Ms. Debarati Sen (Bose) ..for the State Supplementary affidavit filed by the petitioner and a further report submitted by the State are taken on record. It appears that a complaint has been lodged against the Pradhan, Kanainagar Gram Panchayat alleging illegal technical evaluation in gross violation of financial rules and regulations. Investigation is pending against the Pradhan for offence under Section 409/420 of the Indian Penal Code. Be that as it may, it is not in dispute that the petitioner has executed 90% of the work order issued in his favour and was unable to complete the project due to stop work order from the Gram Panchayat.

Learned counsel for the State submits that the remaining 10% work may be directed to be completed by the petitioner upon payment of the earlier dues. In view of the above, this Court is inclined to hold that since the dues of the petitioner are withheld for no fault on his part, the Block Development Officer, Tehatta-I Development Block, being the 7th respondent herein, be

directed to pay the entire amount due to the petitioner subject to fulfillment of all requisite formalities by the petitioner and upon granting reasonable opportunity of hearing to him within four weeks from the date of communication of this order.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
