The petitioner claims that the private respondents are obstructing construction of a boundary wall on her premises.

The petitioner has complained to the Titagarh Police Station, North 24 Parganas in this regard and asked for assistance. The petitioner also complains of inaction by the said police.

This Court is of the view that the dispute between the petitioner and the private respondents is purely civil in nature and the petitioner may approach before the Civil Court in this regard. No interference is called for under Article 226 of the Constitution of India.

This matter has been listed under the heading 'Senior Citizen Matters' misleading this Court that rights of a senior citizen under Article 21 is affected.

No such right has been established before this Court.

The instant writ petition shall stand dismissed with costs assessed at Rs. 8,500/- payable by the petitioner to the State Legal Services Authority.
