Kishan Kumar Shaw v. State Of West Bengal
D/L47 08.04.2026 C.R.M. (M) 470 of 2026 In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973/ correspondence under Section 483 of the BNSS, 2023 filed in connection with Rahara Police Station Case No.140 of 2022 dated 06.05.2022 under Sections 302/34 of the Indian Penal Code and 25/27 of Arms Act;
Kishan Kumar Shaw
Versus
The State of West Bengal Mr. Debasis Kar Mr. Arka Tilak Bhadra Ms. Suhana Parvin.
...for the petitioner.
Mr. Bitasok Banerjee Mr. Debanik Das.
...for the State.
Learned advocate appearing for the petitioner submits Bpg.
Dismissed that the petitioner may be enlarged on bail as there has been noncompliance of the directions passed in CRM(M)2150 of 2025 wherein this Court directed the learned trial court to pronounce the verdict by 31st January, 2026.
Learned advocate for the State, on the other hand, opposes the prayer for bail and produces the certified copy of the learned trial court which reflects that after the examination-in-chief of the investigating officer was over, on each and every date the accused person prayed for time for cross-examination of the investigating officer, thereby stretching the time period after 31.01.2026.
Having considered that the accused has contributed to the delay and stretching of the proceedings, I am of the opinion that this is not a fit case to extend the liberty of bail. As such, the prayer for bail of the petitioner in CRM(M)470 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
