C.R.M. No.1751 of 2012 (Via Video Conference) D/L7 December 21, 2021 Bpg.
In Re: An application for cancellation of bail under Section 439(2) of the Code of Criminal Procedure, 1973;
Sri Provas Samaddar
Versus
Bijoy Laxmi Sahu & Ors.
Mr. Abhra Mukherjee, Mr. Nirupam Dhali.
...for the State.
None appears for the petitioner when the matter is called on.
This is an application for cancellation of bail in respect of an order dated 31.12.2011 passed by the learned Chief Judicial Magistrate, Howrah (Sadar) in connection with Sankrail P.S. Case No.781 of 2011 under Sections 406/347/34 of the Indian Penal Code.
Records of this revisional application reflect that the accused persons were granted bail on 31.12.2011. Mr. Abhra Mukherjee, learned advocate, appears on behalf of the State. His appointment may be regularised by the concerned authorities.
No adverse report has been received from the concerned Police Station regarding any misuse of the bail granted to the accused by the learned Chief Judicial Magistrate, Howrah (Sadar). In view of the time period, which has elapsed in the meantime, which is almost 10 years, I am of the view that no
interference is called for at this belated stage. Accordingly, CRM 1751 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
