Mr. Syed E. Huda Mr. Sk. Aptabuddin Ms. Nabeela Akbar ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff in Title Suit No.101 of 2009 praying for a direction upon the learned Civil Judge (Sr. Divn.), Sealdah to dispose of the said suit expeditiously.

From the order sheets appended to this application it appears that an application under Order 40 Rule 1 of the Code of Civil Procedure dated November 4, 2009 is still pending and the date was fixed on February 10, 2025.

The learned advocate appearing for the petitioner submits that on February 10, 2025 the said application was also not heard.

In the light of the submissions made by the learned advocate for the petitioner, CO 542 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Div.), Sealdah to take up the hearing of the application under Order 40 Rule 1 of the Code of Civil Procedure on the next date fixed and to dispose of the same as expeditiously as possible without granting any

unnecessary adjournment to either of the parties. The learned Civil Judge (Sr. Div.), Sealdah is further requested to dispose of the suit as expeditiously as possible as the same is of the year 2009.

There will be no order as to costs.
