Petitioner was appointed as Assistant Teacher in Geography on and from 5th September, 1992 and was granted honours graduate scale of pay for having honours degree in Geography. Petitioner obtained post graduate qualification in Geography from Vidyasagar University through distance mode of education in 2014. Petitioner claims post graduate scale of pay for obtaining qualification in the relevant subject.

State respondents are represented by learned advocates who submit that Headmaster of the school has re-submitted the prayer for prior permission which needs to be considered in accordance with law Petitioner shall be at leave to make representation before the District Inspector of Schools (S.E.), Howrah being respondent no.3 by fortnight from date claiming post graduate scale of pay for acquiring higher qualification in the relevant subject of teaching. If such representation is made within the aforesaid time,

respondent no.3 is directed to take decision on the claim of the petitioner after granting opportunity of hearing to the petitioner or her representative by eight (8) weeks thereafter and decision to be taken shall be communicated to the petitioner by ten (10) days thereafter.

With the above directions, writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
