1. In the writ petition petitioner no. 1 is wife of deceased employee of Shyama Prasad Mukherjee Port, Kolkata and petitioner no. 2 is son of deceased employee.

2. It is submitted by the learned advocate representing the petitioners that the employee died-in-harness on 30th April, 2020 and thereafter application was made by the wife on 04th May, 2020 seeking appointment on compassionate ground due to untimely death of her husband. It is also submitted that in the month of March, 2025 a proforma was forwarded to the petitioners and filled-in proforma was filed before the concerned authority of Port. However, thereafter no steps till date have been taken for providing appointment to one dependant family member

of the deceased employee on compassionate ground.

Learned advocate representing Port authorities has submitted that name of petitioner no. 2 has been incorporated in central list and there are large number of candidates in the central list in terms of dates of death of respective employees chronologically. It is also submitted that accidental death cases are given preference. It is also contended that due to ban imposed at present appointments are not being given on compassionate ground.

4. Having considered the respective submissions made on behalf of the parties Court finds no purpose would be sub-served in keeping this writ petition pending as it is submitted on behalf of Port authorities that name of the petitioner no. 2 is included in the central list.

5. Leave is granted to the petitioners to make a representation to the Director, Shyama Prasad Mukherjee Port, Kolkata being respondent no.

3 claiming appointment on compassionate ground by fortnight from date. If such representation is made within the aforesaid time respondent no. 3 shall decide the same in accordance with law and pass a reasoned order within 8 (eight) weeks thereafter and

same shall be communicated to the petitioners by 10 days thereafter.

6. Writ petition stands disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
