Sn 15.2.21 C.O. 299 of 2021 ATASI GHOSH & ORS. VS. NILANJANA CHAKRABORTY Ms. Saswati Chatterjee ..for the petitioners This revisional application has been filed by the petitioners/plaintiffs in Title Suit No.309 of 2018, pending before the learned Civil Judge, Senior Division, Barasat, District North 24 Parganas.

The petitioners pray for expeditious disposal of the title suit along with the pending application. The said application has been filed by the opposite party for restoration of water supply. Records reveal that the application has been fixed for hearing on June 8, 2021. Records also reveal that the matter has been referred to mediation.

The petitioners have not filed their written objection to the said application. The said written objection be filed by the petitioners upon service of an advance copy within four weeks from date.

In case the matter is not settled in mediation, the learned court below shall dispose of the said application within 10 days from the next date fixed. Upon disposal of the application, the learned court below shall

proceed with the hearing and shall make serious endeavour for disposal of the same within a year thereafter. If the suit is otherwise settled in mediation then the learned Court below will proceed in accordance with law.

This Court has not gone into the merits of the claim and counterclaim of the parties and the learned Court below shall proceed independently and in accordance with law.

The petitioners are directed to serve a copy of the revisional application along with a server copy of this order upon the opposite party within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
