Learned advocate appearing for the petitioner submits that the petitioner is entitled to make a construction on an immovable property. He submits that such property was gifted to the petitioner. Private respondents are obstructing making of such construction. The police are inactive.

Learned advocate for the State, on the basis of instructions, submits that the complaint of the petitioner was enquired into and prosecution under Section 107 Cr.P.C. was submitted.

Apparently, there are disputes between the private parties relating to an immovable property. It is up to the private parties to have such disputes settled before the appropriate forum in accordance with law. So far as the

police complaint is concerned, it appears that the police acted thereon and prosecution under Section 107 Cr.P.C. was submitted. No further inference is called for by a writ court at this stage.

WPA 4144 of 2021 is disposed of accordingly.
