Learned Counsel for the petitioner has preferred the present writ petition seeking demolition of illegal construction that has been carried out by the private respondents over a piece of land situated at 1/2, Ananta Deb Mukherjee Lane, Shibpur, Howrah. 2.

Learned Counsel for the respondent-municipal corporation submits that petitioner's representation has already been decided and an opportunity of hearing was granted to the petitioner as well as the private respondents on 02.12.2024. After hearing and considering the plea of both the parties, the Corporation has issued self-demolition notice in view of the fact that they had come to a finding that unauthorized construction exists on the above mentioned property.

In view of such submission made by the learned Counsel for the respondent, the petitioner states that his prayers are satisfied.

In view of this, this Court directs that the Howrah Municipal Corporation to take step to conclude the proceeding to its logical end in accordance with law.

With the above direction, the present writ petition is disposed of.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.

Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
