CAN 1 of 2026 has been filed seeking condonation of delay of 9 months days in filing the instant appeal.

Sufficient grounds are available to indicate the delay in filing the instant appeal.

3.

Hence, the delay is condoned.

4.

Accordingly, CAN 1 of 2026 is allowed and disposed of.

MAT 266 of 2026

The appeal is directed against judgment and order dated 8th May, 2025 passed by a Single Bench of this Court.

The appeal is filed with a delay of 9 months. Admittedly, the writ petition was served on the appellant and refused.

7.

The Single Bench was satisfied with service and only directed the representations, made by the brothers of the writ petitioner/respondent to be considered by the Panchayat. Certain parameters have been set out by the Single Bench.

Having regard to the above and the observations of the Single Bench that the Panchayat will hear all parties, this Court is not inclined to otherwise interfere with the impugned order.

It is made clear that both the appellant and the writ petitioner/respondent shall be entitled to make appropriate representations before the Panchayat. If the respondent/writ petitioner does not make any representation, the representation made on behalf of her brothers by their learned advocates shall be considered. The Panchayat shall strictly comply with the directions of the Single

Bench and pass appropriate orders and take steps prescribed under the West Bengal Panchayat Act.

With the aforesaid observations, MAT 266 of 2026 shall stand disposed of.

11.

Consequently, CAN 2 of 2026 shall also stand disposed of.

12.

There shall be no order as to costs.

13.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
