1. Affidavit-of-service filed in Court today is taken on record.

2. Alleging illegal and unauthorized construction at the instance of the respondent no.5 at RS plot No.6053 corresponding to L.R. Dag No.8430 near Bhawani Pukur Ghat Police Station Burdwan Sadar, Post OfficeRajbati, District - Purba Bardhaman, the instant writ petition has been filed.

3. The learned advocate for the petitioner would submit that the private respondent has commenced construction on a plot on the access way to the tank/pond.

4. The private respondent is represented.

5. It is submitted that the construction that has come up on the property which is owned by the private respondent. The same does not infringe with any of the municipal laws.

6. The municipality is represented.

7. The learned advocate for the municipality would submit that he is yet to receive instruction in the matter.

8. Having regard to the above and noting that a complaint has been made as regards the unauthorized construction, I am of the view that the municipality shall enquire into the matter and dispose of the petitioner's representation by passing a reasoned order.

9. With the aforesaid observations and directions, the instant writ petition is disposed of.
