1. This criminal appeal was filed under Section 374 (2) of the Code of Criminal Procedure against the impugned Judgment and Order of conviction and sentenced dated April 5, 1989 passed by the learned Sessions judge, Malda in Sessions Trial No.5 of 1989 convicting the accused/appellant Debu alias Deben Rajbanshi under Section 304 read with Section 34 of the Indian Penal Code and sentencing him to suffer rigorous imprisonment for 7 years.

2. Pursuant to the report submitted on behalf of the State during the pendency the sole appellant expired. Hence this appeal stands abated against the sole appellant.

3. Accordingly, CRA 254 of 1989 stands disposed of being abated.

4. The department is directed to forward the T.C.R along with this order to the concerned Court for information and taking necessary action.

5. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

6. Urgent certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Chaitali Chatterjee (Das), J.)
