The petitioner claims that despite being in the OBC PWD category he has not been selected for the post of Secretary by the DPRDO, Birbhum in the recruitment process dated 7th July 2016.

Counsel for the State places the recruitment notice indicating that there were no post reserved in the OBC-B PWD category. He further submits that the petitioner is guilty of suppression of material fact and misstatement thereof.

The petitioner has participated in the recruitment process as an OBC 'B'

candidate and not an OBC PWD candidate.

In the OBC-B category, the petitioner has secured 34.3 marks whereas the other 7 candidates in the OBC-B category have secured 58.3 and 58.4 marks. Those in the said category with marks higher than the unreserved category candidates, have been absorbed against said unreserved candidates and rest having secured more marks than the petitioner have been absorbed in the OBC-B category.

In the above circumstances, no relief can be granted to the petitioner in this proceeding.
