The present revisional application has been preferred challenging the proceedings relating to Balurghat Police Station Case No. 454 of 2011 dated 12.09.2011 under Sections 468/471/420 of the Indian Penal Code then pending before the learned Chief Judicial Magistrate, Balurghat, Dakshin Dinajpur.
Records reflect that the revisional application has never been pressed till date for admission.
The petitioner approached this Court at a stage when the FIR was registered and the investigation of the case was progressing. The foundation of interference so sought from this Court was on the basis of certain documents which were in custody of the present petitioner.
Having regard to the fact that more than nine years have passed and no information has been furnished to this Court by the petitioner regarding the present stage of the case before the learned jurisdictional court, I am of the view that the points so agitated by the petitioner are in the nature of question of facts which are to be agitated at the appropriate stage of the trial. As such, no interference is called for by this Court at this stage.
Accordingly, CRR 403 of 2012 is dismissed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
