State of West Bengal & Ors.

Petitioner complains that, there is an encroachment onto a highway.
Learned advocate appearing for the State submits that, the complaint of the petitioner was enquired into and the Block Land and Land Reforms Officer was requested to demarcate the area.
In the facts of the present case, it would be appropriate to direct the respondent no.7 to demarcate the area. On demarcation if he finds that, there is an encroachment on the highway, he will take appropriate steps for the purpose of removal of the same. In the event, there is any encroachment found, the authorities will initiate proceedings under the provisions of the West Bengal Highways Act 1964 within a fortnight from date, if not already initiated.
The authorities will conclude such proceedings within a period of eight weeks from the date of commencement thereof.
With the aforesaid directions W.P.A. 2710 of 2020 is disposed of accordingly.
