Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner complains that she being an aged lady has been thrown out of her residence by the private respondent nos. 4 and 5 who are the son and the daughter-in-law. The petitioner also claims that she has 50% share holding in the flat/property and in spite of the same, she has been thrown out of the same. Complaint was made to the local police station. However, the same did not yield any result.

State has submitted a report which reflects that the police authorities have tried for reconciliation and also tried their level best with the aid and assistance of the respectable inhabitants of the locality. However, since the parties were at loggerheads, the issues could not be settled and further the police authorities specifically confronted the petitioner as to whether she requires any police assistance. However, the petitioner refused to take

any police assistance or wanted the police to take any action.

Having considered the peculiar circumstances and the social ramifications, I direct that the Officer-in-Charge, Nager Bazar Police Station will communicate with the District Protection Officer under the provisions of the PWDV Act, 2005. The District Protection Officer would ensure the smooth entry of the petitioner, if required, police will render assistance to the Protection Officer concerned.

The petitioner, henceforth, will communicate with the District Protection Officer concerned.

With the aforesaid observations, the writ petition being WPA 3622 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
