None appears on behalf of the opposite party to oppose this application under Section 24 of the Code of Civil Procedure.

The petitioner has applied for grant of Letters of Administration of the estate of one Susobhon Ghosh registered before the learned Chief Judge City Civil Court Calcutta being L.A. No. 12 of 2017.

The petitioner by the present application is praying withdrawal of the said case from the Court where it is now pending and transfer of it to the Court of learned District Judge 24Pargans (North) at Barasat on the ground that the property in respect of which such Letters of Administration has been applied for is lying and

situate within the jurisdiction of the learned District Judge 24-Parganas (North) at Barasat. The prayer of the petitioner deserves to be allowed since the property in respect of which the said Letters of Administration case has been filed is lying within the jurisdiction of the said learned District Judge 24-Parganas (North) at Barasat .

Let the L.A No. 12 of 2017 (Susobhan Ghosh Vs. Sree Ramkrishna Prema Bihar) therefore, be withdrawn from the Court of learned Chief Judge City Civil Court Calcutta, and be transferred to the Court of learned District Judge 24-Pargnas (North) at Barasat, who may either keep the said proceeding in his own file or may transfer it to any Court competent to try and dispose of it under his Judgeship.

The said proceeding shall be proceeded with from the point at which it was withdrawn.

C.O. 492 of 2020 is allowed with the above terms without any order as to costs.
