The petitioners are aggrieved by the fact that in spite of the civil court passing directions in Title Suit No. 300 of 2023 upon the Officer-in-Charge, Debra Police Station, the police authorities refused to implement the order of temporary injunction dated 12.06.2023. Petitioners informed the order, but in spite of the same no steps have been taken. Learned advocate appearing for the respondent nos. 6 and 7 draws the attention of the Court to the police report. The police report reflects that part of the property has been sold by the petitioners.

State has submitted a report which reflects that on receipt of information regarding violation, police authorities registered a case being Debra P.S. Case No.

430/2024 dated 05.07.2024.

On

conclusion of investigation, charge-sheet has also been submitted before the jurisdictional court. The police authorities would keep a strict vigil and ensure that the order of the civil court is respected, obeyed and implemented. The police authorities will also continue their surveillance and ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioners and the private respondents.

With the aforesaid observations, the writ petition being WPA 3571 of 2024 is disposed of. As no affidavits have been called for, the accusations made against the private respondents and/or the State-respondents are deemed not to have been admitted.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
